Terms of Service

1. Accepting these terms

By downloading, accessing, or using TaxScanZA, you agree to these Terms of Service. If you do not agree, do not use TaxScanZA. You must be legally capable of entering into this agreement under South African law.

2. What TaxScanZA does

TaxScanZA helps you scan, store, optimise, check, and export tax documents for upload to SARS eFiling. It is a document-preparation tool only.

TaxScanZA does not submit tax returns or documents to SARS, provide tax, legal, or financial advice, or guarantee that SARS will accept a document or allow a deduction. You remain responsible for reviewing each document, meeting current SARS requirements, keeping appropriate records, and making all submissions.

TaxScanZA is independent and is not affiliated with, endorsed by, or representing the South African Revenue Service or any government entity.

3. Licence and acceptable use

We grant you a limited, personal, non-exclusive, non-transferable, revocable licence to use TaxScanZA for lawful personal or internal business purposes, subject to these terms and the rules of the app store from which you downloaded it.

You may not misuse the service, interfere with its operation, attempt to gain unauthorised access, reverse engineer it except where the law expressly permits this, use it to process documents unlawfully, or infringe another person's rights.

4. Your documents and device

You retain ownership of your documents. Scanning and document preparation take place on your device. You are responsible for securing your device, maintaining backups where needed, confirming the accuracy and readability of exported documents, and ensuring that you have the right to process any document you use with TaxScanZA.

Deleting the app, losing or damaging your device, operating-system behaviour, or insufficient storage may result in document loss. Do not treat TaxScanZA as your only long-term record store.

5. Free use and Pro purchase

The free version lets you scan and store up to 5 documents but does not include export. TaxScanZA Pro is a R49 one-time, non-consumable in-app purchase that unlocks unlimited documents and export for the store account used to purchase it.

Purchases, billing, restoration, and refunds are processed by Apple App Store or Google Play and are also subject to that store's terms. Prices and taxes may be presented differently by the store. Where applicable, request refunds through the store that processed your purchase. Nothing in these terms limits rights you have under the Consumer Protection Act 68 of 2008 or other applicable law.

6. Availability and changes

We may update TaxScanZA to improve security, compatibility, compliance checks, or functionality. We may change or discontinue features where reasonably necessary. We do not guarantee uninterrupted availability or compatibility with every device, operating-system version, file, or future SARS requirement.

7. Intellectual property

TaxScanZA, including its software, branding, interface, website content, and original materials, is owned by us or our licensors and is protected by applicable intellectual-property laws. These terms do not transfer ownership of that intellectual property to you.

8. Third-party services

TaxScanZA may rely on platform services supplied by Apple, Google, or your device manufacturer. Links to SARS or other third-party websites are provided for convenience. We do not control and are not responsible for third-party services, content, availability, or policies.

9. Warranties and liability

TaxScanZA is provided with reasonable care and skill, but to the fullest extent permitted by law, without warranties that it will be error-free, continuously available, or suitable for every document or tax purpose.

To the fullest extent permitted by law, we are not liable for indirect, incidental, special, or consequential loss, loss of data, lost profits, tax liabilities, penalties, or losses caused by reliance on an output without reviewing it. Where liability cannot lawfully be excluded, our liability is limited only to the extent permitted by applicable law.

Nothing in these terms excludes or limits liability or statutory rights that cannot legally be excluded or limited.

10. Ending use

You may stop using TaxScanZA at any time and remove it from your device. We may suspend or terminate access if you materially breach these terms, misuse the service, or create a security or legal risk. Provisions that by their nature should continue after termination will remain in effect.

11. Changes to these terms

We may revise these terms when TaxScanZA, applicable law, or our practices change. The effective date above will be updated. Material changes will be communicated through the app, website, or another reasonable channel. Continued use after the revised terms take effect means you accept them.

12. Governing law

These terms are governed by the laws of the Republic of South Africa. South African courts have jurisdiction, subject to any dispute-resolution or consumer rights that apply by law.
